Developers eyeing Prosper's Dallas North Tollway corridor now face enforceable rules on landscaping, open space and parking after the Town Council voted Tuesday, July 28, to convert its February design guidelines into binding regulations.

The amendments to Prosper's Unified Development Code also created the town's first formal definition of a dual-brand hotel and require any such project to include at least one full-service brand and win special approval from the council.

Development Services Director David Hoover told the council the amendments convert the February 2026 standards from suggestions into enforceable code.

"What these amendments … do is take those suggestions and turn them into regulations," Hoover said.

Why it matters now

A new section of the Dallas North Tollway from US 380 in Prosper to FM 428 in Celina is set to open in late 2027, according to the North Texas Tollway Authority. Prosper has 3 miles of frontage on each side of the future tollway, giving the town roughly 6 miles of prime corridor to shape before development pressure peaks.

The council first adopted the DNT District Development Standards unanimously on February 24 after the Planning and Zoning Commission recommended approval 6-0 on February 17. Those standards, developed with consultant Paris Rutherford, cover seven sub-districts along the corridor and set minimum open-space requirements ranging from 8% to 10% of gross site area depending on the sub-district.

Until Tuesday's vote, the standards functioned as guidelines.

Now they carry the force of the town's development code.

Dual-brand hotel rules

The new hotel language was prompted by a specific project: a combined Hilton Garden Inn and Homewood Suites by Hilton that drew opposition over its 94 extended-stay rooms. The Planning and Zoning Commission initially voted against the project on March 25, reversed course 4-1 on May 5, and the council approved the special use permit 6-1 on May 19 with the condition that the hotel operate under a Hilton flagship.

Going forward, any developer proposing a dual-brand hotel in Prosper must include at least one full-service brand and secure a separate council approval, giving elected officials a direct say over the format before construction begins.
